The Care Access Patient Experience Network ("CAPEN") is a mission-driven technology platform that helps patients, caregivers, families, healthcare professionals, researchers, and other approved participants preserve and learn from real-world healthcare journeys. CAPEN may use artificial intelligence to support journaling, interviewing, summaries, timelines, search, educational resources, and de-identified analytics.
CAPEN is not a healthcare provider, medical practice, emergency service, insurer, pharmacy, or substitute for professional medical advice. CAPEN does not diagnose conditions, prescribe treatment, or guarantee the accuracy of community or AI-generated content.
Contributors retain ownership of their original stories. By submitting content, contributors grant CAPEN the permissions needed to operate the Platform, display authorized content, and create de-identified or aggregated insights as explained below. CAPEN does not sell personally identifiable patient stories.
Patient and caregiver dignity, autonomy, and trust come first.
Artificial intelligence is used to assist people, not replace healthcare professionals or human judgment.
Commercial sponsors may not rewrite, suppress, or purchase favorable patient stories.
Personally identifiable information will be handled as described in the Privacy Policy and applicable law.
Participation in regulated research will require any additional consent that applicable law or an oversight body requires.
CAPEN may use and commercialize aggregated or de-identified insights, reports, tools, and analytics, subject to these Terms, the Privacy Policy, participant permissions, and applicable law.

These Terms of Use & Participation Agreement (the "Terms") form a binding agreement between you and Care Access Fund, LLC, doing business through the Care Access Patient Experience Network (collectively, "CAPEN," "we," "us," or "our"). These Terms govern your access to and use of CAPEN websites, applications, portals, community features, artificial intelligence tools, content, communications, and related services (collectively, the "Platform").
The Privacy Policy, AI disclosures, research consents, employment agreements, volunteer agreements, and any feature-specific terms presented to you are incorporated by reference when applicable. If a separate written agreement conflicts with these Terms, the separate agreement controls only for the subject matter it expressly addresses.
By accessing or using the Platform, registering an account, submitting content, clicking an acceptance box, or participating in a CAPEN activity, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Platform.
CAPEN is designed to preserve, organize, and responsibly connect the lived experiences of patients, caregivers, families, and other participants so people can learn from similar healthcare journeys.
The Platform may allow participants to create profiles, answer structured questions, maintain journals, participate in AI-assisted interviews, build health-experience timelines, publish approved stories, review educational resources, participate in community discussions, complete surveys, and receive summaries or other tools.
CAPEN is developing and may test, modify, add, suspend, or discontinue features. Descriptions of anticipated features are informational and do not guarantee that a feature will be offered or remain available.
A patient, caregiver, family member, healthcare professional, or other authorized person who submits information, journals, responses, comments, media, or other content to CAPEN.
Information or materials submitted by or on behalf of a Contributor, including text, answers, journals, recordings, images, comments, ratings, resource suggestions, and profile information.
Information processed so that it does not identify, and is not reasonably linkable to, a particular individual using methods CAPEN determines are appropriate under applicable law and its policies.
Information combined across multiple individuals, records, or sources and presented in a manner not intended to identify a specific person.
Artificial intelligence, machine learning, natural-language processing, automated interviewing, summarization, classification, recommendation, search, moderation, analytics, and related technologies used by or for CAPEN.
A systematic investigation, study, survey, advisory activity, or analysis intended to develop or contribute to knowledge. Some activities may constitute regulated human-subject research; others may be quality improvement, product development, education, or market research.
The Platform is currently intended for adults who are at least eighteen (18) years old. CAPEN does not knowingly permit minors to create accounts unless CAPEN later implements a legally reviewed minor-participation program.
You represent that you have legal capacity to enter into these Terms. If you use the Platform on behalf of an organization, you represent that you are authorized to bind that organization.
Do not submit another person's identifiable health information, story, photograph, recording, or confidential information unless you have lawful authority and any consent required to do so. CAPEN may request documentation of authority.
CAPEN may restrict access by location or law. You are responsible for confirming that your use is lawful where you reside.
You must provide accurate, current, and complete registration information and update it when necessary.
You are responsible for maintaining the confidentiality of login credentials and for activity under your account. Notify CAPEN promptly if you suspect unauthorized access.
Accounts are personal and may not be sold, transferred, shared, or used to impersonate another person.
CAPEN may verify identity, professional credentials, organizational affiliation, or authority before permitting access to certain features or displaying profile designations.
Participation is voluntary unless duties arise under a separate employment, contractor, volunteer, grant, or other written agreement.
You agree to submit information that is truthful to the best of your knowledge and to distinguish personal experience, belief, or opinion from verified fact.
You must respect the dignity, privacy, and emotional vulnerability of other participants.
You are responsible for obtaining permission before submitting content owned by another person or revealing another person's confidential information.
A contributor profile, professional badge, employee status, or community role does not constitute CAPEN endorsement of a person's medical, legal, financial, or other advice.
CAPEN encourages respectful, empathetic, constructive, and relevant participation.
You may not use the Platform to harass, threaten, exploit, defame, discriminate against, impersonate, or unlawfully surveil another person; promote hatred or violence; solicit funds without approval; advertise without authorization; distribute malware; bypass security; scrape data; collect user information without permission; manipulate statistics; or engage in unlawful conduct.
You may not present personal opinion as established medical fact, provide individualized diagnosis or prescriptions without authorization, encourage someone to stop prescribed treatment, promote dangerous practices, or intentionally spread materially false health information.
Commercial promotion, recruiting, lead generation, product placement, and fundraising require prior written authorization from CAPEN.
CAPEN provides educational, community, and informational services only. Nothing on the Platform is medical advice, diagnosis, treatment, prescribing, clinical monitoring, or a substitute for an in-person or telehealth relationship with a qualified professional.
Always seek advice from your physician or other qualified healthcare professional regarding symptoms, diagnosis, medications, treatment, and medical decisions. Do not delay seeking care because of content on the Platform.
CAPEN is not an emergency service and does not continuously monitor journals, messages, or posts. In a medical or mental-health emergency, call 911 or the applicable local emergency number, go to the nearest emergency department, or contact an appropriate crisis service.
CAPEN may take reasonable action when it becomes aware of a credible, imminent safety threat, but it has no obligation to investigate, monitor, or intervene in every situation and cannot guarantee that safety concerns will be detected.
Healthcare professionals may provide general education and commentary but should not provide individualized medical advice through community features unless CAPEN has expressly established a legally compliant clinical service.
Participation does not create a physician-patient, pharmacist-patient, therapist-patient, or other professional relationship between a user and any participating professional.
CAPEN may verify credentials but does not guarantee current licensure, competence, or suitability. Users should independently verify credentials and consult their own professionals.
Healthcare professionals remain responsible for complying with licensing, ethics, privacy, documentation, and scope-of-practice requirements.
Caregivers and family members may share their own experiences, burdens, observations, and lessons learned.
Caregivers should avoid disclosing identifiable patient information without permission and should clearly distinguish their own perspective from the patient's perspective.
A caregiver is not presumed to have legal authority to act for a patient. CAPEN may require proof of authorization for account management, access requests, or publication decisions.
CAPEN may use AI Services to ask questions, suggest follow-ups, organize journals, improve readability, create summaries and timelines, recommend educational resources, facilitate search, detect themes, support moderation, assist administrators, and generate de-identified insights.
AI Services may produce inaccurate, incomplete, outdated, biased, or misleading outputs. They may misunderstand context, omit information, or generate content that appears confident but is wrong.
Users are responsible for reviewing AI-generated summaries, profiles, timelines, and other outputs before relying on or publishing them. CAPEN may provide correction tools but does not guarantee human review of every output.
CAPEN does not intend AI Services to diagnose, prescribe, determine eligibility for healthcare, or make clinical decisions. AI-generated educational content is not individualized medical advice.
CAPEN may use third-party AI and cloud providers subject to contractual, security, and privacy controls. The Privacy Policy will describe material categories of service providers and processing where required.
Subject to the Privacy Policy, participant permissions, contracts, and applicable law, CAPEN may use content and interaction data to test, evaluate, secure, and improve Platform features. CAPEN will not knowingly use identifiable Contributor Content to train a general-purpose external model for unrelated purposes without appropriate notice and authorization.
Contributors should review profiles, journals, summaries, and timelines for accuracy and promptly request corrections.
CAPEN may retain original Contributor Content.
CAPEN does not guarantee that any content, statistic, recommendation, resource, or output is complete, current, or error-free.
CAPEN may correct errors, add context, update labels, withdraw content, or revise reports. Material corrections to published analytics may be disclosed when appropriate.
As between you and CAPEN, you retain ownership of the original Contributor Content you create and submit, subject to the rights granted in these Terms.
You represent that you own or control the rights needed to submit the content and that CAPEN's authorized use will not violate another person's rights or applicable law.
You understand that health journeys may include highly sensitive information. You decide what to submit, subject to any separate employment or participation agreement.
Suggestions, ideas, and feedback about the Platform may be used by CAPEN without restriction or compensation, provided CAPEN does not publicly identify you as the source without permission.
You grant CAPEN a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, process, translate, transmit, display, and otherwise use Contributor Content as reasonably necessary to operate, secure, improve, and provide the Platform and your requested services.
For content you designate or authorize for publication, you grant CAPEN a worldwide, non-exclusive, royalty-free, sublicensable license to publish, distribute, display, excerpt, adapt for readability, and promote that content through CAPEN channels, while using reasonable efforts to preserve your meaning and applicable attribution or anonymity preferences.
You authorize CAPEN to create and use De-identified Information and Aggregated Information derived from Contributor Content for education, analytics, benchmarking, quality improvement, research, product development, publications, reports, partnerships, and commercial services, subject to applicable law and the Privacy Policy.
CAPEN will not sell a personally identifiable patient story as a standalone commercial asset. This commitment does not prevent CAPEN from charging for Platform services, sponsored programs, research services, reports, analytics, or access to aggregated or appropriately de-identified insights.
Operational licenses continue while content is stored or used to provide the Platform. Publication licenses continue for materials already published, distributed, archived, or incorporated into completed works, subject to applicable law and removal procedures.
CAPEN's Privacy Policy explains categories of information collected, purposes of use, disclosures, retention, security practices, cookies, rights, and contact methods. The Privacy Policy is incorporated into these Terms.
CAPEN may or may not be a HIPAA covered entity or business associate for a particular activity. HIPAA does not automatically apply to all consumer health platforms or all information voluntarily submitted by individuals. CAPEN will describe any HIPAA-covered service separately when applicable.
CAPEN will seek to comply with applicable federal and state privacy, consumer-protection, security, and breach-notification requirements. Rights may vary by residence and CAPEN's legal status for a specific processing activity.
Subject to verification, applicable law, and exceptions, users may request access, correction, deletion, portability, or information about certain processing through the method identified in the Privacy Policy.
Where required, CAPEN will obtain consent before processing sensitive personal data, including consumer health data, for specified purposes.
A central objective of CAPEN is to transform many individual experiences into responsible patient-experience intelligence that can improve education, research, services, and understanding.
CAPEN may analyze De-identified or Aggregated Information to identify treatment experiences, side effects, quality-of-life trends, caregiver burden, insurance barriers, financial challenges, resource use, emotional themes, satisfaction, and other patterns.
CAPEN may sell, license, sponsor, or otherwise commercialize reports, dashboards, benchmarking, analytical services, educational products, research services, and other offerings based on De-identified or Aggregated Information.
CAPEN will not intentionally attempt to re-identify information it has designated as de-identified except for security testing, validation, legal compliance, or as otherwise permitted by law. CAPEN may contractually prohibit recipients from re-identification.
Because rare conditions or small groups may present greater re-identification risk, CAPEN may suppress, combine, delay, generalize, or decline to publish data.
Analytics describe experiences reported through the Platform and may not represent all patients. Unless expressly stated, they are not clinical research findings or proof of causation.
CAPEN may invite users to surveys, interviews, focus groups, patient advisory boards, usability testing, or research. Participation is voluntary unless required by a separate agreement.
Participation in CAPEN generally does not automatically enroll you in regulated human-subject research. CAPEN or a research partner will seek separate informed consent and oversight when required.
Participation is not compensated. Some activities may offer compensation. Eligibility, payment, taxes, confidentiality, publication, and intellectual-property terms are to be governed by separate agreements.
CAPEN may collaborate with universities, health systems, foundations, advocacy organizations, life-sciences companies, employers, health plans, or other organizations. Funding sources and material conflicts may be disclosed when appropriate.
Withdrawal from a study may stop future participation but may not require destruction of information already lawfully used, analyzed, de-identified, or included in completed research.
CAPEN may publish de-identified statistics, articles, educational materials, trend reports, and benchmarks based on participant information and other sources.
Methods may evolve. CAPEN may use samples, self-reported information, AI classification, estimates, and weighting. Reports may identify material limitations when appropriate.
Unless expressly identified as peer-reviewed or clinically validated research, Platform reports should be understood as descriptive patient-experience information, not scientific proof, medical consensus, or treatment guidance.
Sponsors, advertisers, employers, healthcare companies, and research funders may not purchase favorable patient stories, suppress unfavorable experiences, or dictate CAPEN's editorial conclusions.
CAPEN may identify sponsored content, paid partnerships, or material funding relationships when appropriate.
CAPEN reserves the right to moderate the platform in whatever way necessary.
CAPEN may provide information about manufacturer assistance, foundation grants, copayment support, transportation, government programs, charities, and community resources.
CAPEN does not guarantee program accuracy, eligibility, approval, funding, availability, tax treatment, or suitability.
Users should verify program terms directly with the organization administering the resource and consult appropriate advisors.
CAPEN may receive sponsorship, referral compensation, grants, or service fees related to resources. Material relationships may be disclosed when required or appropriate.
CAPEN may facilitate peer mentoring, caregiver support, group discussions, or introductions based on shared characteristics or experiences as a feature of the platform. Participation in inter-participant features is at each participant's own risk.
CAPEN may conduct reasonable screening but does not guarantee the identity, qualifications, safety, or suitability of any participant.
Users should protect personal contact, financial, and location information and should report inappropriate conduct.
Peer support is not therapy, medical care, case management, legal advice, or financial advice.
The Platform, software, design, branding, questionnaires, workflows, databases, taxonomies, compilations, reports, and CAPEN-created content are owned by or licensed to CAPEN and protected by law.
CAPEN grants you a limited, revocable, non-transferable right to use the Platform for authorized personal or organizational purposes. You may not copy, reverse engineer, resell, scrape, or create competing datasets from the Platform without written permission.
CAPEN names, logos, and slogans may not be used without permission except as permitted by law.
A copyright owner or authorized agent may submit a written complaint identifying the protected work, the allegedly infringing material, contact information, a good-faith statement, and a statement under penalty of perjury regarding authority.
CAPEN may remove or restrict content and may notify the contributor. CAPEN may restore content following a valid counter-notice as permitted by law.
CAPEN may terminate accounts of repeat infringers in appropriate circumstances.
The Platform may link to or integrate with pharmacies, healthcare organizations, foundations, payment providers, cloud services, social media, AI providers, research tools, and other third parties.
Third-party services are governed by their own terms and privacy practices. CAPEN is not responsible for their availability, accuracy, conduct, security, or content.
A link, listing, or integration does not necessarily constitute endorsement.
CAPEN seeks to provide an accessible and inclusive experience and may improve accessibility over time.
Users who encounter an accessibility barrier may contact CAPEN through the contact method published on the Platform. CAPEN will consider reasonable requests, subject to technical and legal limitations.
You consent to receive electronic notices, disclosures, and communications relating to your account and the Platform. Transactional communications may be necessary to provide services.
Marketing messages will be sent in accordance with applicable law and available preferences. You may unsubscribe from marketing, but not essential service or legal notices.
Carrier data and messaging charges may apply.
Any audio shared with CAPEN may be transcribed and/or recorded.
CAPEN intends to use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information and the maturity of the Platform.
No online service is completely secure. CAPEN cannot guarantee that unauthorized access, loss, misuse, or disclosure will never occur.
CAPEN may retain information for account administration, service delivery, legal compliance, safety, fraud prevention, dispute resolution, backups, auditing, research obligations, and business continuity.
Users may request account closure through the method identified on the Platform. CAPEN may verify identity before acting.
Deletion may not remove information from backups or require removal of de-identified data, aggregated statistics, completed reports, lawful records, content shared with authorization, or material needed to protect legal rights.
CAPEN will consider reasonable future-removal requests for identifiable published stories. Removal from CAPEN does not guarantee removal from search engines, archives, screenshots, third parties, or prior publications.
CAPEN may review, label, edit for readability, restrict, decline, or remove content that violates these Terms, creates risk, infringes rights, is misleading, or is inconsistent with Platform purposes.
CAPEN may warn, limit, suspend, or terminate accounts for violations, safety concerns, fraud, inactivity, legal requirements, or operational reasons.
CAPEN is not required to pre-screen or continuously monitor all content.
Upon termination, your right to use the Platform ends. Provisions that by their nature should survive will survive, including licenses, ownership, disclaimers, limitations, indemnification, dispute resolution, and data-retention provisions.
CAPEN may offer free and paid services. Fees, billing terms, refunds, and renewals will be disclosed before purchase.
Some contributors may be employees, contractors, volunteers, research participants, or paid advisors. Compensation and duties are governed by separate written agreements and do not alter these Terms except as expressly stated.
Recipients are responsible for taxes arising from compensation unless law requires CAPEN to withhold or report amounts.
Participation does not create ownership, partnership, joint venture, fiduciary duty, or entitlement to CAPEN revenue, data products, or profits.
CAPEN does not guarantee that any future service will launch or remain available.
Experimental or beta features may be incomplete, unstable, or changed without notice and may be subject to additional terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
CAPEN DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RESULTS.
CAPEN DOES NOT GUARANTEE HEALTH OUTCOMES, SUPPORT, CONNECTIONS, RESEARCH RESULTS, FINANCIAL ASSISTANCE, PLATFORM AVAILABILITY, OR THAT CONTENT WILL MEET YOUR NEEDS.
CAPEN DOES NOT GUARANTEE THE AVAILABILITY OF, OR CONTINUED ACCESS TO, PARTICIPANT RESPONSES, DATA, OR CONTENT. DATA LOSS, UNAVAILABILITY, OR LOSS OF ACCESS TO RESPONSES IS AT THE USER'S RISK.
Some jurisdictions do not allow certain disclaimers, so portions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPEN AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, PROFITS, GOODWILL, OR OPPORTUNITY; OR DAMAGES ARISING FROM RELIANCE ON MEDICAL, COMMUNITY, AI, OR THIRD-PARTY CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPEN'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID CAPEN FOR THE RELEVANT SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).
These limitations do not apply to liability that cannot lawfully be limited.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless CAPEN and its affiliates, owners, officers, employees, contractors, and agents from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful use, your Contributor Content, your violation of these Terms, or your infringement of another person's rights.
CAPEN may assume control of the defense of a matter subject to indemnification, and you agree to cooperate. You may not settle a claim imposing liability or obligations on CAPEN without written consent.
Before filing a formal claim, you and CAPEN agree to provide written notice describing the dispute and attempt in good faith to resolve it for at least thirty (30) days.
Except for claims eligible for small-claims court, requests for emergency injunctive relief, or claims that applicable law does not permit to be arbitrated, disputes arising from these Terms or the Platform will be resolved by individual binding arbitration administered by a nationally recognized arbitration provider under its applicable consumer or commercial rules.
YOU AND CAPEN AGREE THAT CLAIMS WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTION, TO THE EXTENT PERMITTED BY LAW.
You may opt out of the arbitration and class-action provisions by sending written notice to CAPEN within thirty (30) days after first accepting these Terms. The notice must include your name, account email, and an unambiguous statement that you opt out.
Arbitration procedures, location, remote participation, and allocation of fees will be governed by the provider's rules and applicable law. CAPEN will not seek to prevent a user from pursuing remedies available under applicable consumer-protection law.
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except to the extent federal law or another mandatory law applies.
For disputes not subject to arbitration, the parties consent to exclusive jurisdiction and venue in state or federal courts located in Maryland, subject to applicable consumer law.
CAPEN may revise these Terms to reflect legal, technological, operational, or service changes.
CAPEN will post the updated Terms and update the "Last Updated" date. When changes are material, CAPEN may provide additional notice or request renewed consent when required.
Your continued use after the effective date of updated Terms constitutes acceptance, except where law requires another form of consent.
These Terms and incorporated policies are the entire agreement concerning the Platform, except for separate written agreements that expressly apply.
If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective.
Failure to enforce a provision is not a waiver.
You may not assign these Terms without CAPEN's written consent. CAPEN may assign them in connection with reorganization, financing, merger, acquisition, asset transfer, or operation of the Platform, subject to applicable law.
CAPEN is not liable for delay or failure caused by events beyond reasonable control, including disasters, war, labor disputes, internet failures, utility outages, governmental actions, cyberattacks, epidemics, or provider failures.
These Terms do not create rights for third parties except indemnified parties and permitted successors.
Headings are for convenience and do not limit interpretation.
